Software Terms of Use
These Terms of Use (“Terms”) apply to your use of the interactive Suspension Explorer application (the “Hosted App”), provided by Suspension Explorer (“we”, “us”, “our”).
By accessing or using the Hosted App, you agree to these Terms.
1. Hosted App
We grant you a limited, non-exclusive, non-transferable and revocable license to use the Hosted App free of charge for your own business, engineering, research or educational purposes.
You may not resell access to our hosted service or represent that service as your own without our written permission.
2. Open-source Core
These Terms do not replace or restrict the license for Suspension Explorer Core. The current core version is available under the GNU Affero General Public License v3.0 only (AGPL-3.0-only). The applicable open-source license governs use, inspection, modification, distribution and sale of Core and its source code. Alternative commercial licensing is available by separate agreement.
3. Free Hosted App
The Hosted App is currently made available free of charge.
We may introduce paid plans, subscriptions or other charges in the future. You will not be charged unless you expressly agree to the applicable pricing and payment terms.
We may modify, suspend or discontinue the Hosted App, or any part of it, at any time.
4. Simulation Software and Engineering Disclaimer
The Hosted App is a simulation and engineering analysis tool. Its results are estimates based on mathematical models, numerical methods, assumptions and information supplied by the user.
We do not warrant that simulations, calculations, predictions or other outputs are complete, accurate or representative of actual physical performance.
You are responsible for determining whether the Hosted App and its outputs are suitable for your intended purpose.
Simulation results should not be relied upon as a substitute for appropriate engineering judgment, independent verification, physical testing or validation.
You are responsible for reviewing and validating results before relying upon them for design, manufacture, modification, testing, operation or any other real-world application.
5. No Warranty
The Hosted App is currently provided free of charge and on an “as is” and “as available” basis.
To the maximum extent permitted by law, we make no warranty, express or implied, regarding the accuracy, reliability, availability, fitness for a particular purpose or performance of the Hosted App or its outputs.
We do not warrant that the Hosted App will be uninterrupted or error-free.
Any separate software distribution remains subject to the warranty terms in its applicable license.
6. Limitation of Liability
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence.
Subject to the above, and to the maximum extent permitted by law, we will not be liable for any indirect, consequential or special loss, or for any loss of profit, revenue, business, opportunity, anticipated savings or data arising from the use of, or inability to use, the Hosted App.
We will not be liable for loss or damage resulting from reliance upon simulation results or other outputs without appropriate independent verification or validation.
The fact that the Hosted App is provided free of charge is a relevant circumstance in determining the scope of the service provided and any limitations of liability under these Terms.
